1 Overview

These Terms of Service ("Terms of Service") set forth the general terms and conditions of your use of this website ("Site") and the products and services purchased or accessed through this Site (individually and collectively, the "Services").

These Terms of Service and the documents to which they refer form an agreement ("Agreement") between SkyCore Host ("SkyCore Host", "we", "us" or "our") and you. The Agreement is made effective as of the date of your use of the Site or the date of electronic acceptance thereof, whichever occurs earlier. The terms "you", "your", "User" or "Customer" shall refer to any individual or entity who accepts this Agreement, has access to a Customer account at SkyCore Host ("Account"), or uses the Services.

Please read this Agreement carefully before using our Services. By accessing or using the Site or any Service, you agree to be legally bound by these Terms. If you do not agree, you must not use our Services.

2 Contracting Entity and Applicable Terms

The SkyCore Host entity you are contracting with is determined based on your country of residence or place of business:

In the event of a conflict between these Terms and any of the above supplemental policies, these Terms shall govern unless expressly stated otherwise.

3 Eligibility and Authorizations

This Site and the Services are available only to persons who can form legally binding contracts under applicable law. By using this Site or the Services, you represent and warrant that you:

  • Are at least eighteen (18) years old
  • Have the legal capacity to enter into a binding agreement
  • Are not a person barred from purchasing or receiving the Services under applicable laws
  • If registering on behalf of a company or other legal entity, have the authority to bind that entity

Sanctions Compliance: You represent and warrant that you are not ordinarily resident in, and will not use or distribute the Services in, any country or region subject to US comprehensive sanctions — including Cuba, Iran, North Korea, Syria, Russia, or the following Ukrainian regions: Crimea, Donetsk, and Luhansk — nor any areas sanctioned by the US, EU, or UN. You further confirm you are not listed on the UN Security Council Consolidated List, the US Specially Designated Nationals List, the EU Consolidated List, or any similar list maintained by applicable authorities.

4 Account and Its Management

4.1 Account Security

You are solely responsible for all activity on your Account. You agree to:

  • Keep your Account secure using strong, unique passwords and two-factor authentication where available
  • Maintain strict confidentiality of your password and authentication credentials
  • Diligently verify the authenticity of communications claiming to come from SkyCore Host
  • Notify SkyCore Host immediately at support@skycorehost.com of any breach of security or unauthorized Account access

SkyCore Host will not be liable for any loss resulting from unauthorized use of your Account. You may be liable for losses incurred by SkyCore Host or others due to such unauthorized use.

4.2 Account Sharing and Sub-Users

The Services allow you to grant access to your Account to other SkyCore Host customers. By authorizing any person to access your Account, you assume full legal and financial responsibility for their actions within your Account, including any charges incurred, content posted, or violations committed.

4.3 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete. Providing false or misleading information is a material breach of this Agreement and may result in immediate Account termination.

5 Availability of Site and Services

The service uptime guarantee applicable to specific Services is defined in Service Level Agreements (SLA) where applicable. You acknowledge that from time to time this Site may be inaccessible or inoperable for reasons including scheduled maintenance, emergency repairs, upgrades, or factors beyond our reasonable control.

5.1 Beta Services

From time to time, SkyCore Host may offer pre-release versions of new Services ("Beta Services"). By using Beta Services, you acknowledge they are provided "as is", "as available", and "with all faults". We make no warranties regarding Beta Services and reserve the right to modify, suspend, or discontinue them at any time without notice or liability.

Data Backup Responsibility: You agree to independently back up all of your Customer Content at all times. You are solely responsible for backing up your data in all circumstances. SkyCore Host does not warrant that it backs up any Account or Customer Content, and shall not be liable for any data loss regardless of cause.

6 General Rules of Conduct

You agree to use this Site and the Services in full compliance with this Agreement. You are prohibited from using this Site or Services in a manner that:

  • Is illegal, promotes terrorism, violence, hatred, discrimination, or self-harm
  • Engages in fraud, deception, impersonation, phishing, or pyramid schemes
  • Infringes intellectual property rights, trade secrets, or violates privacy rights of any party
  • Contains viruses, worms, malware, ransomware, spyware, adware, or cryptocurrency miners
  • Engages in spamming, hacking, network attacks, denial-of-service attacks, or port scanning
  • Interferes with the security, operation, or integrity of this Site, Services, or third-party systems
  • Harvests or collects email addresses or other personal data without consent
  • Violates any applicable local, national, or international law or regulation

SkyCore Host reserves the right to investigate any suspected violation and may cooperate with law enforcement authorities in prosecuting any such violations.

7 Compliance with Laws

SkyCore Host makes no representation that the content or Services available on this Site are appropriate or permitted in every jurisdiction. By accessing this Site or using the Services, you agree to be solely responsible for complying with all applicable local, state, national, and international laws, rules, and regulations, including but not limited to those governing data protection, export control, consumer protection, and electronic communications.

8 Customer Content and Feedback

Some features of this Site or Services may allow you to post, publish, share, store, or manage materials including designs, images, videos, code, and text ("Customer Content").

8.1 Your Ownership

You retain ownership of all Customer Content you submit. By posting Customer Content, you represent and warrant that you have all necessary rights to grant the licenses described herein and that such Customer Content does not infringe any third-party rights.

8.2 License to SkyCore Host

By posting Customer Content, you grant SkyCore Host a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display your Customer Content as necessary to operate, improve, and promote the Services. This license terminates when you delete your Customer Content, except to the extent that it has been shared with others and they have not deleted it.

8.3 Customer Feedback

Any feedback, suggestions, ideas, or recommendations you provide to SkyCore Host ("Feedback") shall be owned by SkyCore Host and may be used for any business purpose without compensation to you. You hereby assign all intellectual property rights in such Feedback to SkyCore Host.

8.4 Prohibited Content

You may not post, transmit, or store Customer Content that is illegal, harmful, defamatory, obscene, violates third-party intellectual property rights, or violates any provision of this Agreement. SkyCore Host reserves the right to remove any such content without notice.

9 SkyCore Host Content

Except for Customer Content, all content on this Site and Services ("SkyCore Content") — including text, graphics, logos, icons, images, software, and other materials — is owned by or licensed to SkyCore Host and is protected by applicable copyright, trademark, patent, and other intellectual property laws.

SkyCore Content is provided for your personal, non-commercial use only. No right or license under any copyright, trademark, or patent is granted to you under this Agreement except as expressly stated herein. You may not reproduce, modify, distribute, transmit, display, or create derivative works from SkyCore Content without prior written permission.

10 DMCA & Copyright Infringement

SkyCore Host respects the intellectual property rights of others. If you believe that any content hosted on our Services infringes your copyright, please send a notice of claimed infringement ("DMCA Notice") to our Designated Copyright Agent containing the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it on our Services
  4. Your contact information, including name, address, telephone number, and email address
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Upon receipt of a valid DMCA Notice, SkyCore Host will act expeditiously to remove or disable access to the allegedly infringing material. We will notify the account holder of the removal. If you believe your content was wrongly removed, you may submit a counter-notice to the above address.

SkyCore Host has adopted a repeat-infringer policy. Accounts associated with multiple copyright violations may be suspended or permanently terminated.

11 Monitoring of Customer Content

SkyCore Host generally does not pre-screen Customer Content. However, we reserve the right — but have no obligation — to review, monitor, and remove any Customer Content at any time, without notice, if we reasonably believe it violates this Agreement, applicable law, or the rights of any third party.

In cases of violation, we may suspend or terminate your access to this Site, Account, or Services immediately and without prior notice. Such removal does not create any liability on the part of SkyCore Host.

12 EU Digital Services Act (DSA) Supplemental Terms

This section applies to you if you are located in the European Union or using Services falling within the scope of Regulation (EU) 2022/2065 (the "DSA").

12.1 Notice and Action Mechanism

Any person may report allegedly illegal content or content that violates our policies through our abuse reporting system at compliance@skycorehost.com or via our website. SkyCore Host will process such notices in a timely, non-arbitrary, and diligent manner. We may use automated tools to assist in processing certain notices.

12.2 Internal Complaint-Handling

If you are an EU user and you disagree with any content moderation decision SkyCore Host has taken affecting you, you may lodge an internal complaint electronically via compliance@skycorehost.com within six months of being informed of the decision. We will process your complaint free of charge and respond within a reasonable timeframe.

12.3 Out-of-Court Dispute Settlement

EU users may also refer disputes to a certified out-of-court dispute settlement body under Article 21 of the DSA. This option does not affect your right to seek judicial redress.

13 No Spam Policy

We strictly prohibit the transmission of spam through our Services. "Spam" means unsolicited commercial or bulk messages sent via email, SMS, push notifications, or other digital channels without the prior, verifiable consent of the recipient.

You must comply with all applicable anti-spam legislation, including the US CAN-SPAM Act, the EU ePrivacy Directive, Canada's CASL, and all applicable local laws. Violations include, but are not limited to:

  • Using purchased, harvested, or scraped email lists
  • Sending emails without a functioning unsubscribe mechanism
  • Falsifying or obscuring email headers or sender identity
  • Using our infrastructure as an open mail relay

If we determine you have violated our no-spam policy, we have the right to suspend related Services or immediately terminate any Account connected with spam activities. We may also report violations to relevant law enforcement or regulatory bodies.

14 Artificial Intelligence (AI) Services

SkyCore Host may provide AI and machine learning tools to assist in building websites, generating content, or performing other tasks ("AI Services").

  • Input and Output: Your prompts, inputs ("Input"), and AI-generated results ("Output") are considered Customer Content and are subject to all provisions applicable thereto.
  • No Accuracy Warranty: AI-generated Output may be inaccurate, incomplete, or outdated. You are solely responsible for reviewing Output before relying on or publishing it.
  • Intellectual Property: We make no representation that Output is free of third-party intellectual property claims. You are solely responsible for clearing any IP rights in Output before use.
  • Prohibited Use: You may not use AI Services to generate illegal content, misinformation, defamatory material, or content that violates any provision of this Agreement.
  • Improvement: You authorize SkyCore Host to store and use Input and Output in anonymized or aggregated form to develop, improve, and train our AI Services.

15 Additional Reservation of Rights

SkyCore Host expressly reserves the right to deny, cancel, terminate, suspend, lock, or modify access to any Account or Service, with or without notice, for any reason, including:

  • To correct mistakes made by SkyCore Host in connection with any Service
  • To protect the integrity and stability of domain name registries
  • To support fraud detection and abuse prevention efforts
  • To comply with court orders, subpoenas, or applicable laws and regulations
  • To avoid civil or criminal liability for SkyCore Host or any third party
  • To address any breach or suspected breach of this Agreement

16 Links to Third-Party Websites

This Site may include links to third-party websites, products, or services that are not owned or controlled by SkyCore Host ("Linked Sites"). We provide these links for convenience only and do not endorse, control, or assume responsibility for the content, terms, privacy policies, or availability of any Linked Sites.

Your access to and use of Linked Sites is entirely at your own risk and subject to the terms and conditions of such Linked Sites.

17 Fees, Payments, Refunds & Auto-Renewal

17.1 Auto-Renewal

All paid Services are provided on a subscription basis with auto-renewal enabled by default. Services will automatically renew for subsequent subscription periods at the then-current renewal price unless you disable auto-renewal through your Account dashboard before the next Charge Date. You are solely responsible for managing your auto-renewal settings.

17.2 Payment Methods

You agree to provide accurate, current, and complete payment information and authorize us to charge your designated Payment Method for all fees due. We accept major credit and debit cards (Visa, Mastercard, American Express), PayPal, and selected cryptocurrency methods. We may initiate pre-authorization transactions to validate your payment method.

17.3 Pricing and Currency

All prices are displayed in US Dollars (USD) unless otherwise specified. We may display localized pricing in other currencies for informational purposes; all transactions are processed in USD unless a specific local currency option is explicitly offered at checkout. Prices are subject to change with reasonable notice.

17.4 Taxes

All fees are exclusive of applicable taxes unless expressly stated otherwise. You are responsible for all applicable sales, use, VAT, GST, and similar taxes. SkyCore Host will collect and remit applicable taxes where legally required to do so.

17.5 Refunds

All fees for Services are generally non-refundable except as expressly specified in our Refund Policy or as required by applicable law. Refund requests must be submitted within 30 days of the original purchase date. Domain registration fees are non-refundable once a domain has been registered with the registry. Dedicated server setup fees are non-refundable.

17.6 Failed Payments and Suspension

If your payment fails, we will notify you and may attempt to charge your Payment Method again. If payment remains outstanding, we reserve the right to suspend or terminate your Services. SkyCore Host is not liable for any data loss resulting from service suspension due to non-payment.

17.7 SkyCore Balance

Credits in your SkyCore Balance are non-transferrable, do not accrue interest, and expire two (2) years from the date of issuance. Credits have no cash value and cannot be exchanged for money.

To cancel auto-renewal of any Service, log into your Account dashboard and navigate to Services > Manage > Disable Auto-Renew at least 24 hours before the next billing date.

18 Termination and Account Closure

18.1 Termination by You

You may terminate your Account and this Agreement at any time by cancelling all active Services through your Account dashboard and submitting a written closure request to support@skycorehost.com. Cancellation of individual Services does not automatically close your Account.

18.2 Termination by SkyCore Host

SkyCore Host may suspend, limit, or terminate your Account or access to any Service, with or without cause and with or without notice, including but not limited to, if:

  • You breach any provision of this Agreement or any supplemental policy
  • You fail to pay fees when due
  • Your Account is involved in fraud, abuse, or illegal activity
  • Required by law, court order, or regulatory authority
  • We discontinue a Service in its entirety

18.3 Effect of Termination

Upon termination of your Account or any Service: (i) your right to access and use the terminated Service immediately ceases; (ii) we may delete your Customer Content associated with the terminated Service after a reasonable grace period (typically 30 days); (iii) all outstanding fees become immediately due and payable; and (iv) provisions of this Agreement that by their nature should survive termination shall continue to apply, including Sections 8, 9, 10, 22, 23, 24, and 25.

Following account termination, you should export all Customer Content before your Account closes. SkyCore Host is not responsible for any loss of Customer Content after the grace period expires.

19 Product-Specific Terms

In addition to these general Terms, the following product-specific terms apply to your use of the indicated Services. In the event of a conflict, the product-specific terms shall govern for that specific Service.

Web Hosting (Shared, Cloud, VPS, Dedicated, Reseller)

Hosting services are subject to our Acceptable Use Policy and resource usage limits described in your service plan. Excessive resource usage that impacts other customers may result in service throttling or suspension. You are solely responsible for the content hosted on your account. Root access on VPS and Dedicated servers grants full control; SkyCore Host will not perform software installations or configurations unless a managed plan is purchased.

Domain Registration

Domain registration is subject to ICANN policies and the terms of the respective domain registry. You are responsible for maintaining accurate and up-to-date WHOIS information and for renewing your domain prior to expiry. Domain names that expire and enter the redemption period may be subject to additional redemption fees. SkyCore Host does not guarantee the availability of any specific domain name.

Email Services (Business, Enterprise, Titan, Google Workspace, Microsoft 365)

Email services may not be used for bulk commercial email without recipient consent. Storage limits are defined per plan. Accounts that exceed storage limits may experience service interruptions. Third-party email products (Google Workspace, Microsoft 365) are also subject to the respective provider's terms of service.

SSL Certificates

SSL certificates are issued by third-party Certificate Authorities (CAs) and are subject to their respective terms and validation requirements. SkyCore Host acts as a reseller and is not responsible for CA validation decisions or revocations.

Website Builder

The Website Builder is provided as a hosted tool. Websites created using the builder are hosted on SkyCore Host infrastructure and subject to standard hosting terms. You retain ownership of your content but grant SkyCore Host the necessary licenses to host and serve it.

Dark Web Monitor

This Service scans publicly available and partner-sourced databases for compromised credentials. Results are provided for informational purposes only. SkyCore Host makes no guarantee of detecting all compromises or data exposures, and is not liable for any losses arising from monitored or unmonitored breaches.

CodeGuard Backup

CodeGuard is a third-party backup service resold by SkyCore Host. Backup frequency, retention, and restore capabilities are subject to the CodeGuard service terms. SkyCore Host is not responsible for backup failures or data loss attributable to CodeGuard's infrastructure.

20 Service Changes and Discontinuation

SkyCore Host reserves the right to modify, add, change pricing for, temporarily suspend, cease offering, or permanently discontinue any Service at any time. If a Service reaches End-of-Life (EOL), we will use reasonable efforts to notify you at least 30 days in advance by email to your registered address. You are responsible for migrating your data and services before any notified EOL date. SkyCore Host shall not be liable for any loss arising from migration delays on your part.

We may also modify these Terms at any time. Material changes will be communicated to you by email or via a prominent notice on our website. Continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms.

21 Disclaimer of Representations and Warranties

Your use of this Site and Services is at your own risk. All Services are provided "AS IS", "as available", and "with all faults". To the maximum extent permitted by applicable law, SkyCore Host and its officers, directors, employees, agents, affiliates, and licensors expressly disclaim all warranties, whether express, implied, or statutory, including without limitation:

  • Warranties of title, merchantability, and fitness for a particular purpose
  • Warranties of non-infringement of third-party rights
  • Warranties that the Services will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, completeness, or reliability of any content or results

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

22 Liability — Limitations and Exclusions

To the maximum extent permitted by applicable law, SkyCore Host, its officers, directors, employees, agents, affiliates, and licensors shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages of any kind, including but not limited to: loss of profits, revenue, data, goodwill, business, or anticipated savings, arising out of or in connection with this Agreement or the Services, even if SkyCore Host has been advised of the possibility of such damages.

22.1 Aggregate Liability Cap

SkyCore Host's total aggregate liability to you for all claims arising under or in connection with this Agreement shall not exceed the greater of: (a) the total amount of fees actually paid by you for the specific Service giving rise to the claim in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) USD 100 (one hundred US dollars).

If you are an EU consumer, these limitations do not affect any statutory rights you may have under applicable EU consumer protection law, including rights that cannot be excluded or limited by contract.

22.2 Exceptions

Nothing in this Agreement excludes or limits liability for: (i) death or personal injury caused by negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability that cannot be excluded by applicable law.

23 Indemnity

You agree to defend, protect, indemnify, and hold harmless SkyCore Host and its officers, directors, employees, agents, and affiliates from and against any and all third-party claims, demands, actions, costs, expenses (including reasonable legal fees), losses, or damages arising from or relating to:

  • Your use of the Site, Account, or Services
  • Your violation of any provision of this Agreement or any applicable law
  • Your violation of any third-party right, including intellectual property, privacy, or confidentiality rights
  • Any Customer Content you post, transmit, or store through the Services

SkyCore Host reserves the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense. You agree to cooperate with our defense of such claims.

24 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions.

For users outside the United States, this choice of law does not affect any non-waivable statutory protections you are entitled to under the laws of your country of residence (including, where applicable, EU consumer protection laws).

For users in the United Kingdom, this Agreement is additionally subject to the laws of England and Wales for consumer-related matters to the extent required by applicable UK law.

For users in Nigeria, nothing in this Agreement derogates from your rights under applicable Nigerian consumer protection legislation, including the Consumer Protection Council Act.

25 Dispute Resolution & Arbitration

25.1 Informal Resolution

Before commencing any formal dispute resolution process, you and SkyCore Host agree to make reasonable good-faith efforts to resolve any dispute informally. You should first contact us at legal@skycorehost.com with a description of the dispute and your proposed resolution. We will have 30 days from receipt of your notice to attempt to resolve the dispute informally.

25.2 Binding Arbitration

If the dispute is not resolved through informal negotiation, you and SkyCore Host agree to resolve the dispute through binding individual arbitration rather than in a court of law, except as provided below. Arbitration will be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, and judgment on the award may be entered in any court having jurisdiction. The arbitration will be conducted in the English language and seated in Delaware, USA, unless otherwise required by applicable law.

Class Action Waiver: You and SkyCore Host each agree that any dispute resolution proceeding shall be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action or class-wide arbitration. If this waiver is found unenforceable, the arbitration agreement in this section shall be null and void.

25.3 Exceptions to Arbitration

The following disputes are excluded from the arbitration requirement: (i) claims for emergency injunctive or equitable relief to prevent imminent harm; (ii) claims that may be brought in small claims court; and (iii) claims where applicable law prohibits mandatory arbitration (such as certain consumer disputes in EU member states).

25.4 Judicial Proceedings

For any claims not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware, USA. For EU users, this does not affect your right to bring proceedings in the courts of your country of residence.

26 General Provisions

Entire Agreement

This Agreement, together with all documents incorporated by reference (including the Privacy Policy, Acceptable Use Policy, Refund Policy, and any applicable product-specific terms), constitutes the entire agreement between you and SkyCore Host with respect to the subject matter hereof and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral.

Waiver

No failure or delay by SkyCore Host in exercising any right or remedy under this Agreement shall operate as a waiver thereof. A waiver of any right or remedy on any occasion shall not be construed as a waiver of such right or remedy on any subsequent occasion. All waivers must be in writing and signed by an authorized representative of SkyCore Host.

Severability

If any provision of this Agreement is found to be illegal, invalid, or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall remain in full force and effect.

Successors and Assigns

SkyCore Host may assign or transfer its rights and obligations under this Agreement at any time, including in connection with a merger, acquisition, or sale of assets, without your consent and without notice, provided that any assignee agrees to be bound by this Agreement. You may not assign your rights or obligations under this Agreement without SkyCore Host's prior written consent.

Force Majeure

SkyCore Host is not liable for any failure or delay in performance of its obligations caused by events beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, civil unrest, governmental actions, labor disputes, power outages, internet disruptions, or third-party service failures.

Notices

All notices required or permitted under this Agreement shall be in writing. Notices from SkyCore Host to you will be sent to your registered email address. Notices from you to SkyCore Host must be sent to legal@skycorehost.com or our postal address. Notices sent by email are deemed received upon transmission (assuming no bounce or delivery failure).

Headings

Section headings in this Agreement are for convenience only and shall not affect the interpretation of this Agreement.
